Terms & Conditions

These terms and conditions govern the sale of products and services by Coldeye Ltd. to you. Coldeye Ltd is a company registered in England and Wales, company number 15905298 with offices at 1 Ascot Road, Pershore, Worcestershire, WR10 2JJ.

These terms and conditions apply to all products and services listed within our website and are liable to change at any time. Notice is only given in the case of changes affecting existing purchases. By ordering products and services from our website, you are indicating your acceptance to be legally bound by these terms and conditions. These terms and conditions can only be amended with our consent, and are governed by English law. 

By browsing our website, the user accepts the collection of personal data required to comply with this agreement. For more information on how Coldeye uses this information, please view our Privacy Policy and Cookie Policy.

By using our products, the user accepts we will store their data in line with the information that is available on the app, and nothing more. This data may be used for marketing purposes, but will have any personal information omitted. Where possible, the user will be contacted in advance to ask permission for the usage of their data in marketing info.

Payment 

Orders may be taken from us through our website, and once an order is received we will send you an acknowledgement email. This email is not an acceptance of your order. Order acceptance occurs at the moment an order confirmation email is sent to your email address, including shipping and delivery details, and is considered the point that a transaction becomes binding.  

We accept most major credit and debit cards and offer payment through established gateways such as Stripe, PayPal and Google Pay. All prices include VAT at the prevailing rate, with shipping and delivery charges added to the final order total at the checkout phase. Please note, VAT on physical goods will only be charged for the UK. All other countries will need to pay their countries standard rates where applicable. Digital goods have country specific VAT rates set up in accordance with international trading law. Orders must be paid for in full before acceptance 

We take all reasonable care to ensure the price of the product(s) is correct, but there may be instances when this is not the case and products are incorrectly priced. If a product’s correct price at your order date is higher than the price stated to you, we will contact you for instructions before we accept your order. If we accept and process an order where a pricing error is obvious, unmistakable and could reasonably have been recognised by you as mispriced, we may terminate the order, refund any sums you have paid and require the return of any such goods provided to you. 

In the case of unauthorised card usage, Coldeye reserves the right to cancel an order without reason and will not be liable for the failed delivery of products. We reserve the right to refuse service to anyone for any reason at any time. 

Installation and Use

Coldeye products are designed to be simple enough for our customers to assemble and install themselves. To assist with this process, we have included an Installation Guide within your order and have a number of support options available through the contact details above.

All components should be installed according to these installation instructions. While Coldeye products are built to last, we cannot guarantee the efficacy of any products installed incorrectly and any costs incurred as a result of obviously incorrect installation are the customer’s responsibility.

Liability 

While we endeavour to provide full service to our customers at all times, the customer accepts that our services may drop, be suspended or limited due to reasons beyond Coldeye’s control (for instance, the performance of third parties such as satellite providers) and additionally for upgrades to our existing software. Notice of planned software outages will be given to all customers, and it is the responsibility of all customers to act on such notifications. Coldeye accepts no responsibility for losses and damages incurred by the customer during these periods. 

In no event will Coldeye’s liability for damages relating to the end user’s use of (or inability to use) the services provided exceed the amount the end user has paid for the service during the contract period during which the damages are incurred.
